Hearing the Adhan of Fajr while Praying Witr
Question:
What Shall I do if I head the adhan (call of prayer) while offering the witr prayer? If I intended to pray witr three rak`ahs then I heard the adhan, could I just offer the witr only one rak`ah?
Answer:
In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright.
The majority of jurists are of the view that the time of witr prayer starts from the time after praying `Isha’ until the beginning of the time of Fajr (Dawn Prayer). However, if someone is prevented from performing it due to sleep or forgetfulness, until the time of Fajr started before he had prayed the witr prayer, he may perform it before praying Fajr as long as he does not fear that the prescribed fixed time of the Fajr prayer is over. The Prophet (peace be upon him) said: “Whoever sleeps through witr prayer (and misses to perform it) or forgets to perform it, he should perform it as soon as he wakes up or remembers it.” (At-Tirmithi and Ibn Majah)
At the same time, if one intends to pray certain number of rak`ahs of a sunnah prayer, one cannot change it at the middle of the prayer.
